Terms of Service

These terms cover who may use PersonalBrandOS, what the subscription and credit system includes, who owns the content you create with it, and the limits of what an AI-assisted career tool can promise. Plain-language summaries appear alongside each section; the numbered wording is what governs.

Your career data and the content you generate belong to you, not to us.

AI output is a draft to review, never advice to send unchecked.

We cannot promise a job, an interview, or any particular result.

Cancel any time; your plan runs to the end of the period you paid for.

1. Agreement to these terms

PersonalBrandOS is operated by [COMPANY LEGAL NAME] (registration number [COMPANY REGISTRATION NUMBER]), registered at [REGISTERED ADDRESS] ("we", "us"). These terms form an agreement between you and us and govern your use of the PersonalBrandOS website and application (the "Service").

By creating an account or using the Service you accept these terms. If you do not accept them, do not use the Service.

If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation, and "you" includes it.

2. Eligibility and your account

You must be at least 18 years old, or the age of legal majority where you live, to use the Service.

You are responsible for the accuracy of the information on your account, for keeping your password secure, and for everything done through your account. Tell us promptly if you believe your account has been accessed without your permission.

  • One account per person. Do not share credentials or resell access.
  • We may refuse, suspend, or close an account that breaches these terms.
  • You may close your account at any time from Settings.

3. What the Service is, and what it is not

The Service helps you organise your career history, draft professional content, prepare for interviews, and present your work. It uses artificial intelligence to produce suggestions and drafts from the information you supply.

The Service is a drafting and organisation tool. It is not a career advisory, recruitment, legal, financial, immigration, or employment service, and nothing it produces is professional advice. We are not your agent and we do not represent you to employers.

We do not guarantee any outcome. We cannot promise that using the Service will result in a job, an interview, a promotion, a client, increased visibility, or any measurable improvement of any kind.

4. AI-generated content

Content produced by the Service is generated by automated models from the inputs you provide. It may be inaccurate, incomplete, outdated, or unsuitable for your purpose, and different users may receive similar output.

You must review, verify, and edit AI-generated content before you rely on it or publish it anywhere. You remain responsible for everything you publish or send, including any claim about your qualifications, employment history, or results.

Do not use the Service to state qualifications you do not hold or achievements you did not earn. Where the Service produces a figure, a statistic, or a claim about your work, verify it before use.

As between you and us, you own the content you generate through the Service, subject to the licence in section 7.

5. Plans, credits, and billing

The Service is offered on a free tier and on paid subscription plans. Each plan includes a monthly allowance of credits, which are consumed when you use AI features. Current plan inclusions and prices are shown on the pricing page and form part of these terms.

Paid plans renew automatically at the end of each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the period you have already paid for, and you keep access until then.

  • Credits have no cash value, cannot be transferred or exchanged for money, and are not refundable once spent.
  • Unused credits expire at the end of each billing period except where your plan expressly allows rollover, and rollover is capped at the amount stated for your plan.
  • Closing your account or downgrading forfeits any remaining credits.
  • We may change prices or plan inclusions on reasonable notice. Changes take effect at your next renewal, and you may cancel before then.
  • Payments are processed by a third-party payment provider. We do not receive or store your full card details.

6. Refunds and cancellation

Where the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002 gives you a right to cancel an electronic transaction or to a refund, those rights apply and nothing in these terms limits them.

Outside those statutory rights, subscription fees already paid are generally not refundable, because credits and AI usage are consumed as you go. If the Service fails materially and we cannot resolve it in reasonable time, contact us and we will deal with your request fairly.

7. Your content and the licence you give us

You keep ownership of everything you upload or create: your CV, career history, goals, drafts, proof profiles, and generated content ("Your Content").

You grant us a limited, non-exclusive, royalty-free licence to host, store, copy, transmit, and process Your Content strictly to operate and support the Service for you — for example, to send the relevant parts of your profile to an AI provider when you ask for a draft, or to publish a proof profile you have chosen to publish. This licence exists only to run the Service and ends when you delete the content or close your account, save for backups retained for a limited period.

We do not sell Your Content, and we do not use it to advertise to other users.

You confirm you have the right to upload what you upload, and that it does not infringe anyone else's rights.

8. Acceptable use

You agree not to use the Service to:

  • break the law, or infringe the rights of any other person;
  • misrepresent your identity, qualifications, or experience, or impersonate anyone;
  • upload another person's personal information without a lawful basis for doing so;
  • generate content that is defamatory, harassing, discriminatory, or deceptive;
  • send bulk unsolicited messages, or scrape, resell, or redistribute the Service or its output as a competing product;
  • probe, disrupt, or attempt to gain unauthorised access to the Service, its infrastructure, or another user's data;
  • circumvent credit limits, plan restrictions, or usage controls.

9. Third-party platforms and services

The Service helps you prepare content for third-party platforms, including professional networks and job boards. We are not affiliated with, endorsed by, or sponsored by any of those platforms, and their names are used only to describe what the content is for.

Your use of any third-party platform is governed by that platform's own terms. You are responsible for complying with them, including any rules about automation, content, or account behaviour. We are not liable for a third party suspending or restricting your account there.

The Service relies on third-party providers for hosting, AI processing, email, and payments. Their availability is outside our control.

10. Privacy and personal information

We process personal information in line with our Privacy notice and the Protection of Personal Information Act 4 of 2013. The Privacy page explains what we store, when your data is sent to an AI provider, and the export and deletion controls available to you in Settings.

Do not upload special personal information — for example health records, biometric data, or another person's identity documents — unless the Service specifically asks for it and explains why.

11. Availability and changes to the Service

We aim to keep the Service available and working, but we do not promise uninterrupted or error-free operation. Access may be interrupted for maintenance, updates, or reasons beyond our control.

We may add, change, or remove features. Where a change materially reduces what a paid plan includes, we will give reasonable notice and you may cancel.

Features marked beta, preview, or experimental are provided as-is and may change or be withdrawn without notice.

12. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, if your use puts the Service or other users at risk, or if we are required to do so by law. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.

On termination your right to use the Service ends. You may export your data before closing your account, and you should do so, as we are not obliged to retain it afterwards.

13. Disclaimers and limitation of liability

Except as expressly stated in these terms and to the extent permitted by law, the Service is provided as-is and we give no warranties of any kind, including warranties of fitness for a particular purpose or that the output will be accurate or suitable.

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, lost employment or business, reputational harm, or loss of data.

Our total liability to you for all claims in any twelve-month period is limited to the amount you actually paid us for the Service in that period, or ZAR 1,000 if you are on a free plan.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability under the Consumer Protection Act for gross negligence or for death or personal injury caused by our negligence.

14. Indemnity

You indemnify us against claims, losses, and reasonable legal costs arising from your breach of these terms, from content you publish, or from your use of the Service in a way that infringes someone else's rights — except to the extent the claim results from our own breach or negligence.

15. Changes to these terms

We may update these terms. If a change is material we will give reasonable notice, by email or in the app, before it takes effect. Continuing to use the Service after that date means you accept the updated terms. If you do not accept them, stop using the Service and close your account.

The effective date at the top of this page shows when the current version took effect.

16. Governing law and general

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction over any dispute.

Before starting legal proceedings, please contact us so we can try to resolve the matter directly. Nothing stops you approaching the National Consumer Commission or another competent body where the law allows.

If any provision is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. You may not cede or transfer your rights under these terms without our written consent.

These terms, together with the Privacy notice and the pricing page, are the whole agreement between us about the Service.
